NJ Safe Passing Law – What You Need to Know to Stay Safe (and Protected)

New Jersey’s Safe Passing Law: A Life Saving Update Every Driver Should Know
Whether you’re behind the wheel, on a bike, or crossing the street, everyone deserves to feel safe on New Jersey’s roads. But until recently, our laws didn’t offer much protection for vulnerable road users — cyclists, pedestrians, and others who share the road with fast-moving vehicles.

That’s where the New Jersey Safe Passing Law comes in. Passed in 2022 and gaining renewed enforcement focus in 2024, this law is designed to prevent injuries and save lives — while holding negligent drivers accountable.

What the Safe Passing Law Requires

The NJ Safe Passing Law requires drivers to:

  • Move over at least 4 feet when passing people on bicycles, scooters, skateboards, wheelchairs, or on foot.
  • Slow down to 25 MPH if 4 feet of space isn’t possible.
  • Only pass when it’s safe — no sudden swerves, tailgating, or squeezing through.

Why It Matters

According to New Jersey State Police, pedestrian and cyclist fatalities have risen over the past several years — particularly in areas like Monmouth County, where road-sharing is increasingly common.

The new law aims to address this by changing how drivers behave around people — encouraging caution, patience, and responsibility.

What Happens If You Violate It?

Drivers who fail to follow the Safe Passing Law may face:

  • Fines of $100–$500
  • Points on their license
  • Potential criminal charges if injury occurs
  • Civil liability for injuries, including personal injury lawsuits
